Last updated: 7 October 2026. This is a practical template for a shop that sells custom greeting cards and ships them. It is not legal advice. Have a lawyer review it for your province before you publish it. Replace every item in square brackets.
1. Who we are
These terms govern use of https://thecrombiecreative.ca and purchases of custom greeting cards from Crombie Creative (“we”, “us”, “our”).
- Business name: Crombie Creative
We sell custom greeting cards only. We do not sell blank stock, digital downloads, or other products unless a page on this site says we do.
2. Agreement
By browsing the site, creating an account, or placing an order, you agree to these terms and to our Privacy Policy at https://thecrombiecreative.ca/privacy-policy. If you do not agree, do not use the site or place an order.
You confirm that you are at least the age of majority in your province or territory, and that you are buying for personal use or as an authorised buyer for a business. If you order on behalf of a company, you confirm you have authority to bind that company.
We may update these terms. The version in force when you place an order applies to that order. Continued use of the site after we publish a change means you accept the updated terms for future orders.
3. The products
Every card is made to your instructions. Typical options include wording, names, dates, colours, layout, envelope choice, and quantity. What you can customise is shown on the product page and at checkout.
Colours, paper texture, and print finish can look slightly different on screen than on the finished card. Small differences in crop, alignment, or colour that do not affect the readable wording are not defects.
We may refuse an order, or ask you to change it, if the design includes content that is unlawful, hateful, defamatory, sexually explicit involving minors, or that infringes someone else’s rights. We may also refuse orders we cannot produce to a reasonable standard.
4. Your content and proof
You are responsible for the accuracy of names, dates, spelling, and any text or images you supply. Check your order carefully before you pay. After production starts, changes may not be possible.
- If the product page says we will send a digital proof, we will email it to the address on the order.
- You must approve the proof, or send clear corrections, within 2 business days. If you do not reply, we may treat the proof as approved and start production, or we may cancel the order and refund the card price, at our choice.
- Once you approve a proof, or once production starts on an order that does not include a proof, we make the card as approved or as submitted.
- Errors you approved, or that were in the text you supplied, are not our responsibility.
You grant us a limited licence to use the text, photos, and artwork you supply only to make, pack, and deliver your order, and to keep a production record. You confirm you own that material or have permission to use it, including any photo of a person.
We may show anonymised or cropped examples of finished cards in our gallery only if you opt in, or if the design uses only our templates and does not identify you or the recipient.
5. Prices and payment
Prices are shown in Canadian dollars (CAD). Tax is added or included as stated at checkout. Shipping is charged separately unless an offer says otherwise.
We take payment through Stripe or PayPal when you place the order, unless we agree otherwise in writing. We do not start production until payment is received.
If a price is clearly wrong because of an obvious error, we may cancel the order and refund you, or ask you to confirm the correct price before we proceed.
Promotional codes apply only as stated in the offer, cannot usually be combined, and may be withdrawn at any time before you place the order.
6. Placing an order
Your order is an offer to buy. We accept it when we send an order confirmation email. A payment receipt alone is not acceptance if we later email you that we cannot fulfil the order.
The order confirmation will include the goods, the price, any shipping charge, applicable taxes, the delivery address, and these terms, so you have a record of the internet sales contract.
We may cancel before dispatch if the item is unavailable, we cannot produce the design, payment fails or is reversed, or we reasonably suspect fraud. If we cancel, we refund what you paid for that order.
7. Production time
Custom cards are made after the order is accepted and, where relevant, after you approve the proof. The estimated production time on the product page is a guide, not a guaranteed date, unless we confirm a date in writing.
Peak periods, missing information, proof delays, and supplier issues can add time. We will tell you if a delay is likely to be material.
8. Shipping and delivery
We ship to the countries and regions listed at checkout. We do not offer in-store collection unless the site says we do.
- You must give a complete, accurate delivery address. We are not responsible for delay or loss caused by an incorrect address you provided.
- Shipping options, carriers, and prices are shown before you pay. Estimated delivery dates are carrier estimates and are not guaranteed, except where the law says otherwise.
- Risk in the cards passes to you when the carrier delivers them to the address you gave, or to a safe place or neighbour in line with the shipping service you chose.
- Title passes when we receive full payment.
- You are responsible for any customs duties, import tax, or local charges on orders shipped outside Canada. These are not included in our price.
If a tracking scan shows the parcel was delivered and you say you did not receive it, contact us within 7 days of the delivery scan. We will help you with the carrier claim where we can. We may ask for a short statement or photo of the delivery point.
If we or the carrier lose the parcel before delivery, or it arrives with cards that are damaged in transit, tell us within 7 days of delivery or of the expected delivery date, with photos of the packaging and the cards if you have them. We will replace the order or refund you, including outbound shipping you paid, once we confirm the problem. Replacement cards are made to the approved design.
9. Cancellations, changes, and returns
Because each card is made to your specification, you cannot cancel for a change of mind once production has started, and we do not accept returns of correctly made custom cards, except where the law does not allow us to exclude that right.
Before production starts. Email [EMAIL] and we will cancel and refund the card price and shipping if we have not started production or ordered materials for your design. If we have already sent a proof, we may keep a reasonable proof or admin fee of [AMOUNT OR “none”].
After production starts. We will not cancel or refund for a change of mind, a mistake in text you supplied or approved, or because the recipient’s plans changed.
If we get it wrong. If the finished card does not match the approved proof or the order you submitted, or it has a print or making fault that is our error, contact us within 14 days of delivery with photos. We will reprint or refund the affected cards, including reasonable return postage if we ask you to send them back.
Nothing in this section limits rights that cannot legally be limited. In Canada, provincial sale-of-goods and consumer-protection laws still require goods to be of acceptable quality and to match the description. Goods made to a consumer’s specifications are often outside change-of-mind or cooling-off cancellation rules, but those rules differ by province. This section does not take away any right your province does not allow us to exclude.
10. Intellectual property
Our templates, layouts, illustrations, site design, and the Crombie Creative brand are owned by us or our licensors. Buying a card does not transfer those rights. You may use the finished card for its ordinary purpose, including giving it to the recipient. You may not copy our templates to resell, or use our artwork on other products, without our written permission.
If you supply content, you keep ownership of that content, subject to the production licence in section 4.
11. Acceptable use
You must not misuse the site, attempt to access it other than through the interface we provide, scrape it in a way that impairs the service, or use it to send unlawful or infringing designs.
12. Liability
We are responsible for loss that is a foreseeable result of our breaking these terms or failing to use reasonable care, and for loss that the law does not let us exclude.
We are not liable for loss that is not foreseeable, for loss of profit or business opportunity on a consumer order, or for delay caused by an event outside our reasonable control, such as carrier disruption, extreme weather, or failure of a payment or hosting provider.
Subject to the paragraph above, our total liability for a claim about an order is limited to the amount you paid for that order. We do not limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot legally be limited. Provincial consumer laws may give you rights that these terms cannot override.
13. Privacy
We use personal information to take orders, produce cards, ship them, handle support, and meet legal duties, including under Canadian privacy law. Details are in our Privacy Policy at https://thecrombiecreative.ca/privacy-policy. Card wording may include names and dates of other people. You confirm you have a lawful reason to give us that information.
14. Complaints
Email [EMAIL] with your order number and a short description of the problem. We aim to reply within 5 business days. If you are a consumer and we cannot resolve it, you may contact your provincial consumer-protection office or bring a claim in court.
15. Governing law
These terms are governed by the laws of the Province of [PROVINCE] and the federal laws of Canada that apply there. The courts of [PROVINCE] have jurisdiction, except that if you are a consumer you may also bring a claim in the courts of the province or territory where you live, where local law gives you that right.
16. General
- If a court finds part of these terms unenforceable, the rest still applies.
- We may assign our rights and obligations, for example if the business is sold. You may not assign your order without our consent.
- Failure to enforce a term is not a waiver.
- These terms, the order confirmation, and any approved proof are the whole agreement for the order.
